I. Introduction

Dear ladies and gentlemen,
I am Ivet Staykova . I was arrested for the murder of my grandmother Violeta Doneva when I was 18 years and 5 months old . I am currently sentenced to 17 years in prison without any clear and indisputable evidence of my guilt. The purpose of this petition is to have my case reviewed and to obtain an acquittal when the facts are established.

The purpose of the petition is to draw attention to the inconsistencies and shortcomings revealed in the investigation, as well as my serious health problems and the lack of a fair trial. I ask for your support so that truth and justice prevail.

II. Background of the Case

II.1. Childhood and Family Environment

I grew up in an environment of constant family conflict, poverty and emotional stress. From the age of 13, I got into the wrong environment and this led me to use various drugs (Xanax, marijuana, stimulants, hallucinogens). Over time, this addiction deepened and led me to associate with dangerous people.

The difficult conditions at home, the constant arguments between my parents, and the lack of emotional support made me particularly vulnerable to substance abuse. Experts diagnosed me with serious mental health disorders, including borderline personality disorder, mood (affective) disorder, hyperactivity disorder, and panic disorder.

II.2. The Day That Changed My Life

On October 19, 2022, I woke up in a psychiatric clinic in the city of Pazardzhik, under heavy sedation and with many bruises on my body. A week later, I was informed that I was accused of killing my grandmother. At that moment, I was in complete shock and confusion.

III. The Nature of the Accusation and the Problems Encountered in the Investigation

III.1. Incomplete or Unconvincing Evidence

• Absence of blood under my nails: In such a serious crime, one would expect to find clear traces (blood, tissue) under my nails, but no traces were found.

• Serious injuries: During this same period, I had a serious injury that limited my physical mobility (broken hip and pubic bone).

• Locked doors: I didn't have a key to the apartment, yet the door was locked after the murder.

• Unidentified perpetrator in footage: The cameras cannot definitively identify the perpetrator.

• Uninvestigated foreign DNA: Although foreign DNA was found at the scene, the investigation did not focus on other possible suspects.

• Lack of interrogation: I was not questioned in any detail; the crime scene was not immediately secured, which undermined the credibility of the evidence collected.

III.2. Formal and Procedural Deficiencies

• Lack of independent professional assessment: No in-depth psychiatric assessment was undertaken to determine my mental health condition and its impact on my behaviour.

• Lack of respect for the presumption of innocence: According to Article 31 of the Constitution of the Republic of Bulgaria (see sources below), everyone is presumed innocent until proven guilty.

• Limited legal advice: My lawyers did not have adequate access to all the evidence collected and were unable to conduct their own investigation.

IV. Health Status and Subsequent Diagnoses

The stress of the arrest and indictment process led to additional diagnoses: reactive depression and panic disorder. These were added to the psychiatric complications of borderline personality disorder and long-term drug use. I now have six different diagnoses:

1. Borderline personality disorder

2. Mood (affective) disorder

3. Hyperactivity disorder

4. Behavioral problems caused by psychoactive substances

5. Panic disorder

6. Post-traumatic stress disorder (PTSD)

All of these health issues were not sufficiently taken into account during the trial. My mental state could have influenced any self-incriminating statements, but this was not sufficiently examined.

V. Legal Basis for the Request for Retrial and Acquittal

• Presumption of Innocence
  Article 31 (1) of the Constitution of the Republic of Bulgaria. Everyone is presumed innocent until proven guilty.

• Lack of Sufficient Evidence According to
  Section 303, Sub-Section 2 of the Code of Criminal Procedure (CPC) (see links below), a conviction must be based on conclusive and indisputable evidence.

• Failure
  to conduct additional expert assessments and to preserve the crime scene jeopardizes the collection and reliability of evidence.

• Medical Evaluation Not Performed
  A comprehensive forensic medical evaluation was necessary to determine my mental and physical impairment (fractures, mental disorders).

Considering the above, a re-examination of the case by a higher court or reopening of the investigation is mandatory to remove all doubts about the objectivity and legality of the trial.

VI. Call to Society and Institutions

Esteemed members of the judiciary, bar associations, human rights organizations and valuable citizens, this petition is a call for justice. I ask for your support for an acquittal decision or at least for the case to be subjected to a new, independent and detailed investigation.

I believe that with your support we can focus on uncovering the truth and adhering to legal procedures. Your signature, sharing on social media and your applications to the relevant authorities are of great importance to my destiny.

VII. Conclusion

My case is a striking example of how opaque investigative processes and the lack of detailed expert review can result in a conviction that is not based on indisputable evidence . Now I need the voices and support of people who believe in justice and care about the rights of everyone.
